  • How Does Title IX Apply to Pregnant and Parenting Students?

    Title IX is a law that prohibits discrimination based on sex, which includes pregnancy, parenting, and all related conditions such as abortion. This law applies to educational programs and activities that receive federal funding. Pregnancy itself is not considered a disability under the ADA, but it may lead to conditions that can be disabling, such as carpal tunnel, gestational diabetes, or preeclampsia. Such conditions may be temporary disabilities and may qualify an individual for ADA accommodations. Therefore, Title IX requires CSU San Marcos to provide temporary accommodations to pregnant students who meet the ADA 鈥渜ualified individual with a disability鈥 criteria.

    CSU San Marcos must provide pregnant students the same access to school programs and educational opportunities as other students. Your pregnancy should not be a reason for you to drop out of your classes or academic program or to change your educational plans. Your professors and school administrators are not allowed to discriminate against you based on your pregnancy status.

    The university can only require a pregnant student to provide a doctor's certification if all other students with physical or emotional conditions require the same. Pregnant students must receive equal accommodations and support services to those with similar medical needs.

  • Do my professors have to excuse my pregnancy-related absences?

    CSU San Marcos must excuse absences related to pregnancy, childbirth, or any related conditions for as long as your doctor says you must be absent. This policy applies even if no leave policy exists for students with other conditions. Your professors must provide you with a leave of absence for the duration your doctor recommends.

  • Do I have the right to participate in off-campus elements of my program?

    CSU San Marcos must permit you to participate in different opportunities, such as internships, career rotations, and other off-campus elements of your program. For instance, if your program involves fieldwork, you cannot be excluded based on your pregnancy. Additionally, your professor can only mandate a doctor's note for your continued participation if such a note is required for all students with a medical condition that necessitates treatment by a doctor. If a note is needed, your doctor's decision cannot be questioned.

  • How do I handle offensive comments?

    According to , Title IX requires the university to provide training to students, administrators, faculty, and other staff. This training will educate them on the fact that Title IX prohibits discrimination against pregnant and parenting students. It will also help the campus meet these students鈥 unique educational, childcare, and healthcare needs.

    Furthermore, mandates the university to prevent and address sex-based harassment, including harassment based on pregnancy. In case you experience any such treatment, you must seek help immediately. Remember that the law prohibits anyone from retaliating against you for filing a complaint or raising a concern.

  • Can 大发 take my scholarship back when they find out I'm pregnant?

    No, CSU San Marcos cannot terminate or reduce athletic, merit, or need-based scholarships based on pregnancy. If you stay in school, you can keep your scholarship.

  • Can I keep my student status if I take a semester off?

    This depends. At CSU San Marcos, undergraduate students who have enrolled in classes for at least one semester may choose not to enroll for one semester and remain in 'continuous enrollment' (i.e., remain an active, matriculated student and maintain catalog rights). This type of Leave of Absence (LOA) is called an "out-one term.鈥 To request an LOA, a student must have completed one term. An LOA cannot be submitted for the first sesmeter at 大发.

    To submit a request for leave of absence, please complete the Undergraduate Leave of Absence form and submit it to the Office of the Registrar before the first day of classes for the semester requested.   • Do I have the same rights as a student employee?

    Your rights as an employee are different from your rights as a student. If you work for CSU San Marcos, you may be eligible for family or medical leave or qualify for maternity leave under the school鈥檚 policy. However, that may not include leave from your classes beyond what is medically necessary.
