Cal State San Marcos and the University Police Department are committed to providing
a safe and welcoming campus for everyone. We want every member of our community to
know that it is safe to interact with and seek
assistance from the University Police Department, no matter who you are and no matter
how you self-identify.
The primary jurisdiction for the enforcement of federal immigration laws concerning
unlawful entry into the United States rests with U.S. Immigration and Customs Enforcement
(ICE), not with the University Police Department
(UPD) or other local law enforcement agencies. Individuals will not be contacted,
detained, questioned or arrested by UPD solely on the basis of being or suspected
of being undocumented. University Police will not enter into agreements with state
or local law enforcement agencies, U.S. Immigration and Customs Enforcement (ICE),
or any other federal agency for the enforcement of federal immigration law, except
as consistent with California Government Code 7282 or as required by law. University
Police will not honor ICE immigration hold requests, unless doing so is consistent
with California Government Code 7282 or as required by law. The University Police
Department does not conduct sweeps or other efforts to detain suspected undocumented
members of the community, unless immigration
status is relevant to another criminal offense or investigation (e.g. harboring,smuggling,
terrorism).
It is our hope that by clarifying the University Police department stance on immigration enforcement, all members of our campus community will feel confident in knowing that the University Police Department is a partner in creating a safe and inclusive environment for everyone.
